Welcome to House of Mosara ("House of Mosara," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of https://houseofmosara.com/ (the "Website") and any purchase, transaction, or interaction you make through it (collectively, the "Services"). By accessing or using the Website, placing an order, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. About Us

House of Mosara is operated by M/s Mosara and Company, a partnership firm registered in India, with its registered address at Sector 47, Gurgaon, Haryana – 122018, India. For any queries, you may contact us at people@houseofmosara.com.

2. Eligibility

There is no age restriction to purchase from House of Mosara. However, by placing an order, you confirm that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872, and that all information you provide to us is accurate and complete.

3. Products and Pricing

  • All product descriptions, images, and prices displayed on the Website are for general information and are subject to change without notice.
  • All prices listed on the Website are in Indian Rupees (INR) and are inclusive of applicable taxes, unless stated otherwise at checkout.
  • We make reasonable efforts to ensure that pricing and product information on the Website is accurate. However, in the event of a pricing or typographical error, we reserve the right to cancel any order placed based on the incorrect price, and will notify you and issue a full refund in such cases.
  • Product colors, packaging, and fragrance notes may vary slightly from images shown due to display settings or natural product variation; this does not constitute a defect.

4. Orders and Order Cancellation

  • Placing an order on the Website constitutes an offer to purchase, which we may accept or decline at our discretion (for example, in cases of suspected fraud, pricing errors, or stock unavailability).
  • You may cancel your order at any time before it has been shipped, by writing to us at people@houseofmosara.com with your order number. Once an order has been shipped, it can no longer be cancelled, and our standard Refund & Return Policy will apply instead.
  • Cancelled orders will be refunded to your original mode of payment within a reasonable timeframe, in accordance with your bank/payment provider's processing times. For Cash on Delivery (COD) orders cancelled before dispatch, no charge will apply.

5. Stock Availability and Backorders

  • We make reasonable efforts to keep product availability on the Website accurate. In the rare event that an item you have ordered is out of stock:
    • We may offer you the option to place the item on backorder, to be shipped once it is restocked; or
    • If you do not wish to wait, you may cancel the affected item/order, and we will process a full refund to your original mode of payment.
  • We will notify you by email of any stock issues affecting your order and the available options.

6. Payment

  • We accept payments through the payment methods made available at checkout, including online payment (via our payment gateway partner) and Cash on Delivery (COD), where available.
  • Full payment card and bank details are collected and processed directly by our payment gateway partner and are not stored by House of Mosara. Please refer to our Privacy Policy for more details.
  • We reserve the right to refuse or cancel any order where we suspect fraudulent, unauthorized, or abusive use of a payment method.

7. Shipping and Delivery

Shipping timelines, charges, and delivery terms are set out in our Shipping Policy, which forms part of these Terms. We currently offer free shipping across India, with Cash on Delivery available in most serviceable pincodes.

8. Returns, Replacements, and Refunds

Our Refund & Return Policy (available on the Website) sets out the terms under which returns, replacements, and store credit are offered, and forms part of these Terms. Please review it carefully — in particular, note that returns are accepted only for items received damaged or incorrect, and must be reported within 7 days of delivery.

9. Intellectual Property

All content on the Website — including the House of Mosara name, logo, product names, packaging design, photography, graphics, and text — is the property of M/s Mosara and Company or its licensors, and is protected under applicable Indian intellectual property laws, including the Trade Marks Act, 1999 and the Copyright Act, 1957. You may not reproduce, copy, distribute, or create derivative works from any content on the Website without our prior written consent.

10. Prohibited Use

You agree not to:

  • Use the Website for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Website, our systems, or other users' accounts;
  • Use any automated means (bots, scrapers) to access or extract data from the Website without our consent;
  • Post or transmit any harmful, defamatory, or unlawful content through the Website;
  • Interfere with the proper functioning of the Website.

We reserve the right to suspend or terminate access to the Website for any user who violates these Terms.

11. Disclaimer of Warranties

The Website and Services are provided on an "as is" and "as available" basis. While we take care to ensure our products are of good quality and accurately described, we do not warrant that the Website will be uninterrupted, error-free, or completely secure. To the maximum extent permitted under applicable Indian law, we disclaim all warranties, express or implied, other than those that cannot be excluded under the Consumer Protection Act, 2019.

12. Limitation of Liability

To the maximum extent permitted under applicable law, House of Mosara and M/s Mosara and Company shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Website or Services. Our total liability arising out of any order shall not exceed the amount paid by you for that order. Nothing in these Terms limits any liability that cannot be excluded or limited under the Consumer Protection Act, 2019, or other applicable Indian law.

13. Indemnification

You agree to indemnify and hold harmless House of Mosara, M/s Mosara and Company, and its partners, employees, and representatives from any claims, losses, or damages arising out of your violation of these Terms or misuse of the Website.

14. Force Majeure

We shall not be held liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from causes beyond our reasonable control, including natural disasters, strikes, courier/logistics disruptions, government restrictions, or other unforeseeable events.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, products, or legal requirements. The revised Terms will be posted on this page with an updated "Last updated" date. Continued use of the Website after such changes constitutes your acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India.
  • Any dispute, controversy, or claim arising out of or relating to these Terms, the Website, or any purchase made through it, shall first be referred to and resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually by the parties (or, failing mutual agreement, appointed in accordance with the Act). The seat and venue of arbitration shall be Gurgaon, Haryana, and the language of arbitration shall be English.
  • Subject to the above, the courts at Gurgaon, Haryana shall have exclusive jurisdiction over any matters not covered by, or arising from, the arbitration process (including interim relief).

17. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and House of Mosara regarding your use of the Website and Services.
